General Terms and Conditions (GTC)

of Soft Car Wash AG, Spittelweg 1, 5034 Suhr

1.
Soft Car Wash provides all cleaning and maintenance services in connection with the use of its car wash facilities exclusively on the basis of these GTC as well as the operating instructions at the entrance of the car wash. Vacuum systems for vehicle interior cleaning are not subject to these GTC. Their use is at the sole responsibility of our customers. These GTC are displayed clearly visible before the entrance to each car wash so that they can be read by the customer.

Soft Car Wash guarantees proper, gentle, and safe cleaning of vehicles, in accordance with the state of general car wash technology at the time the car wash is used. The decisive factors for proper cleaning are, on the one hand, the degree of dirt and the selected wash program, and on the other hand, the performance that can usually be expected from a fully automatic car wash according to the current state of general car wash technology.

The user must assert any claims for rework due to insufficient cleaning immediately after leaving the facility, otherwise these claims are forfeited. Soft Car Wash expressly reserves the right to perform rework. Claims for rescission, reduction in price, or damages are excluded in this case.

The user of the car wash is obliged to draw the staff’s attention in good time to circumstances that could result in a risk of damage to the vehicle or the car wash. This applies in particular to improperly attached vehicle parts (e.g., trim, mirrors, antennas, spoilers, fog lights, turn signals, headlight wiper systems) or parts that are not part of the standard equipment. If the user of the car wash fails to inform the staff about essential circumstances and sources of danger, or fails to follow the instructions of the operator or staff, liability for any resulting damage is rejected in full.

Soft Car Wash is liable to the owner for compensation for any damage only insofar as this is based on circumstances that could have been averted by applying the necessary care and is attributable to gross negligence on the part of Soft Car Wash. Conversely, liability for damages caused by the failure to observe clearly displayed, unambiguous entry and usage instructions is excluded. Liability for damages caused by negligence or simple fault is also excluded.

In the event of damage caused by the washing process in the car wash, Soft Car Wash is liable exclusively for the direct damage, provided that gross negligence is proven and no reason for exclusion exists, and provided that rework is not possible. Consequential damages will not be compensated.

7.
Liability for damage to parts attached to the exterior of the bodywork, e.g., trim, mirrors, antennas, spoilers, auxiliary lights, etc., as well as for resulting paintwork and scratch damage, remains excluded, unless Soft Car Wash has culpably and grossly violated the required standard of care in traffic.

Soft Car Wash excludes liability for damage to the following vehicle parts: tires and rims with a width of more than 32 cm, tires with a height of less than 5.5 cm, vehicles with a ground clearance of less than 9 cm, vehicles with a total height over 2.15 m, vehicles with a total width over 2.25 m with mirrors unfolded, rims with protruding rim edges, vehicles with track wideners on the rear axle, vehicles with non-factory-fitted, retrofitted vehicle parts, and damage triggered by vehicle sensors (esp. windshield wipers). Damage to anodized parts is also excluded from liability.

9.
Entering the wash hall or exiting the vehicle during the wash process is prohibited. Any liability for damages incurred by the customer is rejected.

10.
Claims for compensation for obvious damage can only be asserted if the damage has been reported to the responsible facility manager before leaving the property on which the car wash is located.

11.
Should a clause of these GTC or a part thereof be or become invalid, the validity of the remaining provisions shall remain unaffected.

12.
The place of jurisdiction for all claims arising from and in connection with the use of our car washes is – unless there is a mandatory applicable place of jurisdiction – the registered office of Soft Car Wash.
